You hereby agree to be bound by the following terms in this Go Homebuyer Link and Logo "Agreement."

1. Real Estate eLearning, LLC, a Missouri limited liability company d/b/a Real Estate Educate ("REE."), is the owner of the website, www.gohomebuyer.com ("GH."). REE is also the owner of the Go Homebuyer logo. You and REE are sometimes individually or collectively referred to herein as a party or the parties. In consideration of your use of GH and the Link described below, you hereby agree as follows.

2. Pursuant to the terms herein, you have a non-assignable license to use the GH link and associated logo (the "Link.") on your website or printed materials for the limited purpose of linking or directing others to GH in connection with your public service, nonprofit, or professional marketing or promotional activities. You may not modify the appearance or functionality of the Link. You agree that REE may terminate your right to display and use the Link on your website at any time for any reason. Upon the request of REE, you shall immediately remove the Link from your website.

3. You may not use the Link if your website or printed materials contain, promote or link to any controversial or unacceptable content including, but not limited to: violence or hatred; criminal or illegal activities; terrorism, terrorist sites, sexually explicit material; discrimination based on race, color, sex, religion, nationality, disability, sexual orientation or age; libelous, defamatory, disparaging, obscene, offensive or other content that an ordinary person would deem inappropriate; material that infringes on trademark, copyright or patent rights of another person. You agree that such content is not permitted, now or in the future, so long as the Link is on your website or printed materials. A violation of this section shall constitute an immediate and automatic termination of your right to use the Link on your website and printed materials, without the necessity of receiving any notice as such from REE.

4. The Link shall be used solely for legitimate business purposes. By clicking on the Link, a user must land on the home page of GH. When a user clicks on the Link, there shall be no pop-ups (including pop-overs and pop-unders), fake close behavior or any other interference with the user´s ease of browsing.

5. This Agreement does not confer any intellectual property rights from one party to the other. You may only use the Link for the limited purposes and times herein stated. You shall not make any representations or warranties with respect to GH or any products, services or information therein. You shall not state or represent that you control, are controlled by, are affiliated with or have been endorsed by, REE. To the extent that you offer any incentives or discounts related to your users´ or customers´ visit to GH or use of any products or services available therein, you shall be solely liable for honoring such incentives and discounts and you shall expressly and prominently state as such near the language offering the incentive or discount. The parties understand and agree that users shall be subject to the terms of use and privacy policy of the website they are using, whether such use was directed by the Link or otherwise.

6. The parties acknowledge and agree that they are not partners or joint venturers. The parties agree that neither party shall be liable for any content, advertising, products, services or functionality located on, or related to, the other party´s website. Notwithstanding any of the foregoing, a party may be liable for breaching this Agreement if such breach causes liability, costs, expenses, claims or damages (including attorneys´ fees and expenses) to the other party.
